Bull v Gain Capital Holdings Inc [2014] EWHC 539 (Comm) (Commercial Court, London, Walker J)

The claimants formed part of a group of over 450 investors in an unauthorised investment scheme operated by Cameron Farley Ltd. The claim was brought under the Financial Services and Markets Act 2000 against the first three defendants trading as forex.com, who operated a retail foreign exchange platform in New York, on which over £10 million of the investors’ moneys was gambled and lost. The forex.com defendants had appointed Cameron Farley as an introducing broker and “white label” partner. Walker J refused to strike out the claims against the forex.com defendants. Gerard McMeel acted for the investors with Hugh Mercer QC (of Essex Court Chambers).
