Throughout his article, the third in a series of insolvency papers we are launching over the coming weeks, Simon considers the impact of insolvency on Pension Rights.

The article deals with the historical treatment of pension rights in bankruptcy; the effect of the sweeping legislative reforms enacted by the Pensions Act 1995 and the Welfare Reform and Pensions Act 1999; and the impact of recent case law, in particular the decision of the Court of Appeal in Horton v Henry [2016] EWCA Civ 989. It also analyses the position in other Commonwealth jurisdictions and considers areas for potential future reform.
