Katie Gibb practises in all areas of Insolvency and enjoys a broad Commercial litigation practice, with particular specialism in Partnership Disputes.

She acts in all areas of commercial and personal Insolvency, representing a wide range of clients. Katie is skilled at handling employment-related Insolvency cases, and has developed a strong reputation for her considerable expertise in both Personal and Corporate Insolvency issues.

Expertise

Katie has been consistently recommended under Insolvency and Restructuring in the leading directories. Her practice covers all areas of insolvency law.

She is experienced in representing clients at all levels of tribunal and also regularly represents clients at mediation.

On the Personal Insolvency side, she represents both trustees and debtors on a wide range of applications including contested statutory demand and bankruptcy petitions, transaction avoidance claims, annulments and Individual Voluntary Arrangements ( IVAs).

On the Corporate Insolvency side, she deals with all aspects of administrations, liquidations and transaction avoidance claims. Katie has specific experience in employment related insolvency matters and advises in relation to Transfer of Undertakings (TUPE).

Katie recently advised a multi-million pound family property trust in relation to a claim by a bankrupt beneficiary’s trustee in bankruptcy. The case required careful consideration of the interplay between trust principles and the Insolvency Act 1986.

Katie acts for a wide range of businesses and individuals covering all aspects of Commercial litigation. Katie regularly advises clients pre action, and is an experienced high court advocate in interim applications and injunctive relief. Her practice area covers a wide range of sale of goods, complex contractual disputes and breach of warranty / misrepresentation claims.

Katie also has expertise in Employment related matters and regularly advises in relation to Breach of Covenant matters and restraint of trade, particularly in the context of industrial relations.

Partnership Disputes

Katie has a particular specialisation in partnership disputes and has acted for a wide range of clients and business, including professional partnerships such as doctors and dentists.

She advises both pre and post issue and covers such issues as identification of partnership property, treatment of post dissolution profits and all aspects of taking partnership accounts.

Contested Probate – Wills

As regards formal validity of wills, Katie has wide experience of s 9 Wills Act 1937 claims, will construction and interpretation issues as well as advising on the substantive validity of the will by reason of lack of capacity, want of knowledge, or approval or allegations of undue influence.

Katie also advises in property disputes which arise after death, including arguments involving estoppels and trust issues.  She has experience of advising in donatio mortis causa claims.

Contested Probate – Inheritance Act Claims

Katie regularly advises in claims under the Inheritance (Provision for Family and Dependants) Act 1975, both for Claimants and Defendants.  She regularly undertakes work pre issue and believes that negotiating an early settlement can be beneficial to all involved.  Her advice is sensitive, pragmatic and commercial.

Katie undertakes a wide range of trust work involving co ownership disputes, contested trusts of land and equitable remedies.

Katie has particular expertise in express, resulting and constructive trusts in a wide range of situations, including family breakdown, cohabiting or commercial contexts.

She regularly advises in Trusts of Land and Appointment of Trustees (TOLATA) claims, and her clients include beneficiaries, third parties and trustees / office holders.

Katie acts in a full range of banking and financing disputes for lenders and borrowers.

She has significant experience advising in relation to banking and mortgage disputes, particularly in relation to mortgage shortfall recoveries by lenders against borrowers.

She also acts in disputes arising out of guarantees and surety claims.
