The last few weeks have seen a spate of cases which consider the thorny question of whether a Notice of Appointment can be e-filed when the court office is closed. Unhelpfully, those decisions are not wholly consistent and there remains a high degree of confusion and uncertainty.
In this article, Simon Passfield (who appeared for the applicant administrators in Re Skeggs Beef Ltd [2019] EWHC 2607 (Ch)) analyses those decisions and attempts to make sense of the current legal position.
