Coronavirus Regulations - Update 1 June 2020

The third amendment to the Health Protection (Coronavirus, Restrictions) (England) Regulations 2020 was made on 31 May and came into force on 1 June. The amendment made significant changes to, inter alia, Regulations 6 and 7. 

In summary, Regulation 6, which originally restricted leaving the place where you are living, instead now restricts staying overnight at a place other than where you are living. It is (again) subject to having a reasonable excuse, which includes those listed in Reg. 6(2). 

Reg. 7 provides that no person may participate in a gathering which takes place in a public or private place

(a) outdoors, and consists of more than six persons, or

(b) indoors, and consists of two or more persons, unless para. 2 applies.

The para. 2 exceptions include persons from the same household gathering and where the gathering is reasonably necessary for one (or more) of the reasons in Reg.7(d). A gathering is: “…when two or more people are present together in the same place in order to engage in any form of social interaction with each other, or to undertake any other activity with each other…” (Reg.7(3)(a)). Consistent with the return of professional sport, there are express provisions relating to, and exceptions to both Regs. for, elite athletes.
