Guildhall Chambers offers expertise in all areas of Professional Negligence and indemnity law.

Our members are widely recognised as being some of the strongest Professional Negligence barristers based in the South West, advising and advocating beyond this region, acting against solicitors and barristers from Manchester to London.

Barristers within our Professional Negligence team act both for or against professionals in respect of negligence, breach of contract, breach of fiduciary duty and breach of trust. We are particularly well-respected for our specialist knowledge and skill in areas such as Banking & Finance and Insolvency.

Members of our Professional Negligence team have appeared at all levels of the Court system from the Supreme Court to the High Court to the County Court, where a considerable amount of work is done.

Our clients include individual claimants and defendants (whether privately funded or funded by legal aid or trade unions), legal expenses insurers, group claimants, major insurance companies and Lloyds underwriters. We also undertake CFAs and licensed access.

Professional Negligence Experience

Many members of the team are published having produced leading textbooks as well as having written articles and delivered seminars.

Recent work in this field includes Cheltenham Borough Council v Bevan Brittan LLP (a multi-million solicitors’ negligence claim relating to development site in Cheltenham); Re Altala ( a multi-million professional negligence proceedings brought against former administrators in relation to loss of chance in relation to claim against insured defendant directors, relating to failure of health lottery company.); Re Overfinch Bespoke Vehicles Ltd (in liquidation) (acting for the joint liquidators of Overfinch Bespoke Vehicles Limited (a company which customised Land Rover and Range Rover cars which entered into administration in 2010) in pursuing multi-million pound misfeasance claims against the former administrators of the company.); and Dayani v Investec (representing applicant in proceedings requiring a receiver to agree to sale of development property in London owned by company owned by Dayani; raising questions as to the extent to which a court can direct an LPA appointed receiver).
