Jess specialises in Property, Trusts and Estates and Employment & Discrimination.

Jess appears regularly in the High Court, the County Court, the Employment Tribunal and First Tier Tribunal (Property Chamber) at all stages of proceedings.

Jess enjoys a busy advisory practice and is also available for mediations. She is a member of the Attorney General’s ‘junior junior’ panel and undertakes work on behalf of the GLD.

Before coming to the Bar, Jess worked for over a decade in the education sector.

Expertise

Jess accepts instructions across a wide range of property, trusts and estates matters, including:

  • Landlord and tenant (residential and commercial)
  • Boundary disputes and adverse possession
  • Easements and covenants
  • Nuisance, trespass and other property torts
  • Proprietary estoppel
  • Constructive and resulting trusts of land
  • Cohabitation disputes
  • Interpretation of wills
  • Inheritance (Provision for Family and Dependents) Act claims

Examples of Jess’ recent work include:

  • Representing the defendants to a 1975 Act claim, achieving settlement at a Financial Dispute Resolution Hearing
  • Advising on and settling pleadings in a claim concerning a challenge to the validity of two wills
  • Representing executors in CPR Part 64 claims
  • Advising on, drafting pleadings and acting in possession claims involving discrimination defences; given Jess’ dual areas of practice, she is particularly well placed to take on this type of work
  • Acting in a complex commercial possession claim involving estoppel defences, listed for a 2-day multi-track trial
  • Advising on the interpretation of rent review clauses in a lease
  • Defending an application for relief from forfeiture
  • Advising on rights of way, boundary disputes and adverse possession in a case concerning a school, involving conflict between proprietary interests and safeguarding duties
  • Settling statements of case in the First-tier Tribunal (Property Chamber)
  • Acting in TOLATA proceedings, including between family members and between former business partners.

Jess appears regularly for claimants and respondents, and accepts instructions across all areas of employment & discrimination work, including:

  • The full range of discrimination claims
  • Unfair and wrongful dismissal
  • TUPE transfer
  • Contractual disputes including those over wages and holiday pay
  • Whistleblowing
  • Industrial action / trade union related matters
  • County court proceedings concerning breaches of the Equality Act 2010
  • Civil litigation involving employment law issues

Examples of Jess’ recent work include:

  • Successfully representing an employer in a four-day discrimination and whistleblowing trial, achieving strike out of several of the claims on Day 1, and dismissal of the remainder at the conclusion of trial
  • Advising on a civil claim brought by a contractor in the financial services sector, alleging breach of restrictive covenants
  • Successful representation of a vulnerable claimant in a four-day discrimination trial, including a successful application for an anonymity order at the outset of trial
  • Representation of a claimant at a remedy hearing, resulting in a finding that there was a 0% chance that the claimant would have been dismissed in any event
  • Successfully defending a civil claim for breach of contract brought post-termination of employment
  • Successfully defending a national recruitment agency against allegations of breach of the Agency Workers Regulations 2010
