Martin Lanchester is a member of the Personal Injury and Clinical Negligence teams. He is able to take instructions covering a range of Personal Injury and Clinical Negligence matters representing both Claimants and Defendants.
Martin is instructed to assist with fast track trials, multi-track trials, infant approvals, Costs advocacy, and provides thorough and timely advice on liability and quantum.
He is also regularly instructed in Inquest hearings acting for families of the deceased and other interested parties.
Martin has an increasing Costs & Litigation practice. He is regularly instructed for both paying and receiving parties and undertakes all areas of work including detailed and provisional assessments.
He is an experienced advocate, having spent a number of years as a Crime practitioner and was included on the specialist panel for prosecutors undertaking serious Sexual Crime. Following on from this, Martin has a particular interest in abuse claims.
Martin is approachable and flexible, and more than happy to undertake cases on a Conditional Fee Agreement (CFA) basis.
Martin has a wealth of experience in Personal Injury, and acts for both Claimants and Defendants in a wide range of Personal Injury claims. He is particularly experienced in the handling of cases involving elements of fraud or fundamental dishonesty.
He is regularly instructed to assist with multi-track and fast track trials, infant approvals, costs advocacy, and provides thorough and timely advice on liability and quantum.
Martin has a broad range of experience of appearing in the Coroner’s Court with a particular interest in matters arising out of Clinical Negligence.
A complex delayed cancer diagnosis case, where opportunities were missed to correctly diagnose an Upper GI tumour.
An adult suicide case, where repeated pleas for help were made to mental health services.
A fatal reaction to the insertion of a standard chest drain in a patient with significant co-morbidities.
The death of an elderly man on the day he was discharged from hospital.
Martin has a keen interest in all areas of Costs Litigation, and is regularly instructed for both paying and receiving parties. He undertakes all areas of work including detailed and provisional assessments and Costs and Case Management Conference’s.
He has a particular interest in portal and fixed cost cases. He was recently instructed in the case of Davies v ASDA Stores Ltd (2015) unreported in which he successfully argued on appeal that costs for applications for pre-action disclosure in ex-portal cases should be limited to the fixed costs under Part 45.
Martin is a member of the Court of Protection team and recently started taking on health and welfare cases. As a specialist in clinical disputes, personal injury and coronial law Martin has extensive experience communicating with and representing vulnerable individuals, often acting for families of the bereaved and those without capacity.
