When calculating losses in the Employment Tribunal, how can practitioners accurately and persuasively calculate lost pension rights? How can legal professionals be confident in assessing, advising and acquiring compensation?

Suzanne Staunton and Geraint Probert discuss the practical implications for advisers on both sides of litigation when faced with potential claims for lost pension rights, and in particular asking:

  • What is the effect of the removal of the ‘Compensation for Loss of Pension Rights’ Guidance (2003) and what can advisers rely on when making their calculations?
  • What tables or authorities can be relied upon?
  • Are there different rules for different pension schemes?
  • What future reforms and guidance are forecast and/or likely?

This session is designed to give lawyers of up-to-5 years post-qualification experience a solid platform when dealing with these common and sometimes tricky questions, whilst hopefully extinguishing a degree of stress and uncertainty along the way.
