Property & Estates Seminar @ The M-Shed

The Guildhall Chambers Property and Estates team are pleased to announce that they will be hosting their annual half-day seminar at the M-Shed in Bristol on the afternoon of 29th June 2016.
The afternoon will begin with a short talk by HHJ McCahill QC, the specialist Chancery Judge in Bristol, on practice and procedure in the Bristol District Registry which will include guidance on the appropriate allocation and transfer of cases between the District Registry and the County Court.  This will be followed by a short question and answer session.

The seminar will be accredited with 3 CPD points and will also include talks by Guildhall team members followed by a choice of workshop sessions.

SEMINAR PROGRAMME 

13.30: REGISTRATION 

14.00: Keynote talk – HHJ McCahill QC
HHJ McCahill QC will address practice and procedure in the Bristol District Registry including providing guidance on the appropriate allocation and transfer of cases between the District Registry and the County Court. This will be followed by a short question and answer session.

14.30: Adverse Possession: Boats, Criminals and Cricket
Ewan Paton will provide a light-hearted but detailed consideration of some notable recent court and First Tier Tribunal decisions on adverse possession involving unusual subject-matter but important principles of substantive law and procedure.

14.50: Proprietary Estoppel and the Common Intention Constructive Trust
Matthew Wales will undertake a review of the last year of case law to assess the legacy of the House of Lords’ decisions in Thorner v Major and Stack v Dowden.

15.15: TEA & COFFEE BREAK

15.30: Prescription, Trustees’ Duties of Disclosure and other recent cases of practical importance
Malcolm Warner will be reflecting on key decisions from the last few months and offering up a smorgasbord of delights including analysis of the recent Supreme Court decision in Lynn Shellfish v Loose, an important case on the prescriptive acquisition of easements, and the decision of Master Mathews in Blades v Isaac which concerned trustees’ disclosure of information to beneficiaries, what to do when in doubt and a valuable analysis of the costs issues.

16.10: WORKSHOPS

1. Undue influence – Ross Fentem & Jay Jagasia

  • How to run or defend a claim involving allegations of undue influence in the grant of a security over real property.
  • What is influence, and when it is undue?
  • The use and abuse of presumptions.
  • Third parties: how does it all go wrong?

2. Misrepresentation claims in relation to property purchases – Matthew Brown & Holly Doyle 

  • Common issues arising in misrepresentation claims in property purchases.
  • Misrepresentation in pre-contractual statements and alternative claims.
  • The enforceability and effect of exclusion clauses.
  • Limitation periods.
  • When is it appropriate to plead fraud?

3. Noticing the problems: Common issues involving Landlord & Tenant Notices – Michael Selway & Oliver Mitchell

  • Housing Act 1988 section 21 notices.
  • Residential service charge demands.
  • Lease terms, construction and other issues.

There is a charge of £20.00 + VAT per delegate.  The seminar is free of charge for trainee solicitors.
