When big firms go bust: avoiding the consequences of head-contractor insolvency
It is the season for high profile business failures in the construction industry. You will be advising clients who have been directly or indirectly involved with large contractors whose business has failed – or appears to be at risk of imminent failure. In this short evening seminar, we will give some bite-sized analysis of a range of the key points that should be borne in mind when advising. In particular, we will consider the implications for performance bonds and guarantees, the insolvency process, procurement issues as well as contractual rights associated with an insolvency event.
We will also consider ways in which professional negligence and the assertion of property rights may be able to mitigate the effects of an insolvency.
