Secondary victims claims are claims that still have the potential to confuse even the most experienced of practitioners. Although the intention of the ‘gateway criteria’ may have been to stop the floodgates and to bring clarity to this area of law, neither aim has been realised – at least not fully.

In this webinar James Bentley will recap on what is required to establish a secondary victim claim, including an analysis of the most recent guidance in the case of Paul v Royal Wolverhampton NHS Trust [2020] EWHC 1415 (QB).
