Join us for the second in our Spring series of Financial Services webinars.
On 11 March 2021, the Court of Appeal handed down judgment in Morley (t/a Morley Estates) v The Royal Bank of Scotland Plc [2021] EWCA Civ 338.
The facts of the case offered an opportunity for the Court to examine the extent to which lenders owe any and if so what duties to their borrowers when offering a loan restructuring service and deciding on the exercise of enforcement powers following default; the current state of the law as to what duties may be owed in these circumstances is at best a patchwork such that the case is illustrative of a wider need for more holistic judicial intervention.
