Philip Hughes is a specialist Personal Injury and Clinical Negligence practitioner who deals solely with multi-track litigation. He represents both claimants and defendants on the full spectrum of issues within these practice areas, including at Inquests and in associated Costs matters.

Expertise

Philip has a well-established Claimant Personal Injury practice dealing exclusively with multi-track litigation. He has experience and knowledge comfortably beyond his year of call and his opponents are almost invariably considerably senior to him.

Having qualified as a doctor before coming to the Bar, Philip is particularly adept at dealing with cases involving catastrophic injuries and complex medical causation.

He has represented claimants across a full range of liability and quantum issues, including:

  • Currently representing a young Claimant who suffered a right ankle fracture and now requires a fusion before the age of 30. The claim is pleaded at c. £0.5m.
  • Currently representing a Claimant who suffered serious injuries in a fall at a recycling centre. The claim is pleaded in excess £1m.
  • Securing 6-figure settlement for Claimant who suffered multiple injuries in an RTA, including a mild TBI.
  • Securing settlement in excess of £200,000 at JSM for a Claimant who suffered pelvic fractures and chronic pain following an RTA.
  • Settling a complex somatisation case at JSM for the Claimant where causation and quantum remained in dispute.
  • Securing 6-figure settlement for Claimant who suffered a complex fracture of his right elbow in a fall at work. Liability remained in dispute at the time of settlement.
  • Successfully representing 3 claimants in a 2-day multi-track liability trial arising from a 3-year-old child being struck by a car and subsequently negotiating a favourable quantum settlement.

    • Representing the Defendant in a claim involving unusual peripheral nerve injuries and complex loss of earnings. The matter settled for less than 25% of the pleaded value following service of a robust Counter Schedule drafted by Philip.
    • Successfully representing the Defendant in a 5-day High Court trial involving issues of fundamental dishonesty. The matter was settled on favourable terms part-way through Philip’s cross-examination of the Claimant.
    • Successfully representing a Defendant in a 2-day multi-track trial concerning an accident at work.
    • Representing the Defendant in a procedurally complex matter where the Claimant was a Litigant in Person who lacked capacity.

    Philip has been recognised by Chambers and Partners as an Up and Coming Individual in Personal Injury since 2024.

    Philip has a successful Clinical Negligence practice and is increasingly sought after to represent claimants and defendants. He works exclusively on matters of at least 6-figure value, often involving multiple experts and complex issues of liability and/or quantum. He also has experience as junior counsel.

    He is increasingly sought after for his medical and legal expertise. He is able to utilise his qualification as a doctor to quickly identify, understand and advise on the key issues in cases, even whilst they remain in their infancy.

    Examples of Philip’s recent work include:

    • Currently acting for the bereaved family of an individual who died of cardiac arrest following failure to identify and treat angina by his GPs and Health Board. The matter is pleaded at c. £0.75m.
    • Currently acting for the Defendant Health Board in a matter where the Claimant lost vision in his left eye following delayed diagnosis of meningioma.
    • Representing a Claimant who suffered a stroke following the failure of his GP surgery to identify and treat hypertension. The matter was recently successfully settled at JSM for in excess of £300,000.
    • Securing settlement in excess of £250,000 at JSM for a Claimant who underwent negligently performed ACL repair.
    • Currently acting for the Defendant Health Board in a case involving alleged delayed diagnosis of atrial septal defect in a newborn.
    • Advising the prospective Claimants in a contractual claim where a fertility clinic had inadvertently destroyed their IVF embryos.
    • Currently acting for a Claimant incorrectly diagnosed with epilepsy in the 1970s who has suffered brain injury by reason of the anti-epileptic drugs he was prescribed. The claim is pleaded in excess of £1m.
    • Securing favourable settlement for the widowed Claimant in a fatal accident claim arising from delayed diagnosis of multiple myeloma.

    Philip is recognised by Legal 500 as a Leading Junior in Clinical Negligence.

    Philip has a growing Costs Litigation practice representing both paying and receiving parties across a full range of issues arising primarily from complex personal injury and clinical negligence litigation.

    He undertakes CCMCs, represents parties at assessment, and advises on discrete costs issues at all stages of litigation.

    Philip has experience representing a full range of interested parties at inquests, including families, Health Boards, NHS Trusts, and medical professionals.

    Examples of recent inquests and coronial work he has been involved in include:

    • Representing the family at Article 2 inquest arising from the incorrect transfer of a Covid-negative patient to a Covid-positive ward. The Coroner was persuaded that the Deceased’s Article 2 rights had been breached.
    • Representing the Health Board in a multi-day inquest arising form the death of a young boy following delayed attendance of an ambulance.
    • Advising a coroner on judicial review proceedings brought against him for his decision to discontinue an investigation without holding an inquest.
    • Persuading the Coroner to issue a PFD report in circumstances where a care home resident had choked to death whilst being spoon-fed by a staff member.
    • Representing the family of a Deceased child in delicate circumstances where the question of possible suicide was raised.

    In appropriate cases and where there are prospects of a successful civil claim, Philip is willing to undertake inquests on a nil uplift Conditional Fee Agreement (CFA) basis.
