Sophie is a barrister specialising in personal injury, clinical negligence and inquests.

Sophie is regularly instructed in both fast track and multi-track matters and appears in CCMCs, interlocutory hearings and trials. She also accepts instructions in the Court of Protection and undertakes regulatory work.

Expertise

Sophie’s experience and expertise in personal injury litigation includes road traffic accidents, employers’ liability, public liability, the Highways Act 1980 and product liability. She is regularly instructed to draft pleadings, to advise and she has a busy court practice.

Sophie regularly advises on the prospects of cases, including the consequences of bringing or defending allegations of fundamental dishonesty, and concerning quantum or settlement. Sophie is also instructed in claims with vulnerable parties or where there are issues over capacity.

Recent examples of Sophie’s work include:

  • Settlement on behalf of a Claimant concerning a secondary-victim claim in excess of £300,000 following a successful joint-settlement meeting in which Sophie was praised for her “hard work” and “attention to detail”
  • Securing settlement on behalf of a Claimant who was assaulted at work in which allegations of fundamental dishonesty were made
  • Successfully resisted an application to amend a claim to include allegations of ex-turpi causa and securing settlement on behalf of the Claimant
  • Successfully represented a Defendant in a 3-day multi-track trial concerning an accident in a nature park resulting in the dismissal of the claim
  • Successfully resisted an application seeking to add a party upon the expiry of the limitation period

Prior to commencing her pupillage, Sophie worked in a leading clinical negligence firm during this time, she was seconded to work in an NHS legal department.

Sophie continues to develop her busy practice in this area and is regularly instructed to advise, including in conference, she further drafts pleadings and assesses merits. She regularly engages with experts in conference and is able to digest complex issues concerning breach and causation.

Sophie has dealt with a variety of clinical negligence claims, which have included:

  • Development of pressure damage
  • Inadequate nursing care
  • Delayed diagnosis, including delayed cancer diagnosis
  • Inadequate consent
  • Negligent surgery
  • Delayed treatment and incorrect treatment
  • Medication errors

Sophie is prepared to act under a nil-uplift CFA where appropriate.

Sophie has experience of attending inquests on behalf of bereaved families, Health Boards and on behalf of medical professionals. Sophie typically represents parties at inquests where the death arises from negligence of employers, road traffic accidents or negligent medical treatment.

Sophie has experience in advising over potential conclusions, Prevention of Future Death reports and the engagement of Article 2.

Examples of recent inquests and work include:

  • Represented a family at inquest in a death concerning the provision of mental health services to a vulnerable young adult in which Article 2 was engaged and the Coroner issued a PFD report
  • Represented a family at inquest arising from the death due to delays in ambulance attendance and further delays at hospital in receiving treatment for bowel obstruction
  • Represented a family at inquest in a death concerning delayed cardiac intervention and care
  • Instructed in a 3-day inquest where the death concerned a failure to adequately monitor the deceased
  • Represented a party at inquest in a case concerning suicide

Sophie is prepared to accept instructed under a conditional fee agreement in appropriate cases.

Sophie is regularly instructed on behalf of P via the Official Solicitor, Local Authorities and Health Boards. She is experienced in both s.21A and s.16 proceedings and is regularly instructed to advise on capacity evidence, deprivations of liberty and procedure.

Sophie has experience in dealing with complex cases including those relating to contact restrictions, consent to sexual relationships, fluctuating capacity, sedation and restraint.

Sophie represents both regulators and registrants in Fitness to Practise proceedings. She regularly represents parties in hearings lasting 5 or more days in cases involving allegations their clinical practise, misconduct, health issues and convictions. Sophie regularly advises on evidence, legal challenges, allegations and outcomes. She further represents parties at interim and substantive order hearings.

Sophie continues to develop her costs practice; she is experienced in advising on costs including the applicability of the fixed costs regime and any exceptions to the same. She is experienced in dealing with CCMCs and raising arguments in respect of Wasted Costs applications, and cost consequences following judgment.

Sophie is also instructed to advise on the implications and consequences of offers to settle including Part 36 offers, the applicability of QOCS and the recoverability of costs.

Sophie has experience in dealing with both summary and detailed assessment of costs and welcomes instructions for the same. She also has experience in dealing with matters involving Conditional Fee Agreements both pre and post LASPO and Damages Based Agreements.
