Matthew Brown: “The Removal of Executors and Associated Claims” – Matthew will address the perennial problem of the recalcitrant executor, their misuse of estate property and how to remove personal representatives who obstruct the administration of an estate.
Tim Walsh: “Recent developments in claims for financial provision under the Inheritance Act” – Following the Court of Appeal’s most recent ruling in Ilott v Mitson [2015] EWCA Civ 797 and the reforms introduced by the Inheritance and Trustees’ Powers Act 2014, Tim will consider the current landscape in Inheritance Act claims with particular emphasis on quantifying claims by adult children of the deceased.
Raj Sahonte: “Dying Gifts and the Rule of Forfeiture in Homicide” – A donatio mortis causa is a gift of property by the deceased during his lifetime which is conditional on his death. Such gifts can raise a host of issues and complications (often overlooked by executors) and Raj will be exploring those issues together with a review of the interesting recent developments on forfeiture and homicide.
Malcolm Warner, Ewan Paton & Michael Selway: “10 common problems in contentious probate” – Whether it is the difficulty of distributing an estate with a grant in common form which is the subject of an intimated challenge or the problem of a caveat following an unmeritorious Appearance to a Warning, there are a number of issues in contentious and non-contentious probate practice that arise with alarming regularity. Malcolm, Ewan and Michael will run through a number of these, offer tips and advice on the most appropriate solutions.
