Guildhall Chambers Annual Property Seminar Programme

  • 08:30 – 09:15 – Joining and refreshments
  • 09:15 – 09:30 – Chair’s address
  • 09:30 – 10:15 – An Anniversary Present for the LPA 1925: LA Micro in the UKSC
    • A century has passed since the enactment of the LPA 1925. Whilst there have been legislative amendments over that time, the LPA 1925 continues to govern fundamental issues in property and trusts law. Chris Stoner KC and Chris Hare will discuss the implications of the UKSC decision in LA Micro, which is a suitable anniversary present for the LPA 1925 and its supporters
  • 10:15 – 10:45 – Esoteric Trusts in Spotlight
    • Jay Jagasia and Ollie Murrell will discuss recent case law which has considered and applied Pallant v Morgan and De Bruyne v De Bruyne principles, including the recent decision of the High Court in Friends of Becky Addy Wood v Bradford-on-Avon Town Council, seemingly the first case where a court has accepted that a constructive trust could arise notwithstanding that it was intended that the alleged beneficiary would not acquire a proprietary or financial interest in the alleged trust property.
  • 10:45 – 11:00 – Break and refreshments
  • 11:00 – 11:30 – First things first
    • Oliver Mitchell and James Fuller discuss restrictive covenants, the essential steps to take before making an application pursuant to either s.84(1) or 84(2) of the LPA 1925, and some salutary lessons from recent Upper Tribunal (Lands Chamber) decisions.
  • 11:30 – 12:00 – Residential Tenancies, what next?
    • Nicholas Evans and Jess Sharratt consider the implications of the wide-ranging proposals put forward in the Renters Rights Bills, including removing fixed term tenancies, abolishing the section 21 possession procedure, rent controls, extended enforcement powers and new housing standards.
  • 12:00 – 12:45 – That Was The Year That Was: a round-up of property case law
    • Kate Harrington, Michael Selway and current pupil Zachariah Pullar will look at some of the recent decisions of which practitioners in this field should be aware, from another busy year for proprietary estoppel to land registration, trusts of land and more besides.
  • 12:45 – 14:00 – Close and lunch
