Kate Harrington is a real property law specialist and qualified mediator.

Up until recently, Kate was a senior lecturer at UWE teaching the Bar Professional Course (BPC). Previously, Kate was also a lecturer in Law at the University of Exeter.

She accepts instructions in cases concerning land registration, public and private rights of way, boundary disputes, adverse possession and co-ownership of land as well as riparian rights and land drainage issues. She appears in the High Court, County Court and other tribunals and has been led in the Court of Appeal. Kate has a particular specialism in TOLATA, specifically issues surrounding co-habiting couples and the division of the family home upon separation.

Kate is qualified to undertake Public Access work in appropriate cases.

Recent cases:

Representing claimant at a 3-day boundary dispute trial. The trial included cross-examination of experts and arguments on interpretation of original conveyancing documents.

Successfully represented the Applicants at 3-day trial in FTT property Chamber over their disputed application to register a right of way. The case involved historic use of a right of way and the application of the principles under the Prescription Act 1932 and alternatively Lost Modern Grant.

Represented the Defendant in a boundary dispute, including use of right of way. Kate was successful in achieving an injunction against the Claimants for interference with her right of way.

Representing the Claimant at a 2-day trial against former partner over ownership of a large property. Kate was successful in achieving 50% ownership.

Acting for claimant over a severance of commons rights in gross around half a century ago on unregistered land. The dispute turns on the case of Bettinson v Langton [2001] UKHL 24, proprietary estoppel and the interface with local Commoners’ Council.

Advising client who wanted to sell a plot of unregistered land for development. In particular, advised on whether a previous deed contained sufficient right of ways and services across adjacent land for the purposes of residential development.
