Emily Girvan-Dutton is a pupil barrister practising in the Personal Injury and Clinical Negligence teams. She began her pupillage in October 2025 under the supervision of Oliver Manley and Kriti Upadhyay.

Before commencing pupillage, Emily worked as a paralegal at a leading clinical negligence firm, where she acted on behalf of NHS Resolution and its Trusts.

During university, Emily developed a keen interest in the intersection of medicine and law, which led her to undertake research alongside human rights attorney Clive Stafford Smith into the use of medical evidence in cases of non-accidental head trauma in children, particularly suspected Shaken Baby Syndrome cases.

Following this, Emily devised and carried out an investigation in Mississippi, USA, into the homicide conviction of Tasha Shelby, a woman whom medical experts now consider was wrongly accused of killing her stepson. Research findings obtained by Emily formed part of Tasha Shelby’s appeal against conviction to the Mississippi Supreme Court in 2023.

Emily further explored her interest in this area by writing a dissertation as part of her undergraduate degree, examining best approaches to providing legal redress for victims of unconsented vaginal examinations during labour. Additionally, she was a member of her university’s Law Clinic and provided pro bono representation to clients in the local area, including representing a family at an inquest following the death of their mother in hospital.

Emily is keen to develop her practice in the areas of clinical negligence and personal injury during the practising component of pupillage.
