Emily Girvan-Dutton is a barrister practising in the Personal Injury, Clinical Negligence and Court of Protection teams. She completed her pupillage in October 2026 under the supervision of Oliver Manley and Kriti Upadhyay.

Emily accepts instructions on behalf of both Claimants and Defendants in the Small Claims Track, Fast Track, and Intermediate Track.

Emily has experience acting in a wide range of personal injury matters, including employers’ liability, public liability, credit hire, and road traffic accident claims. She appears regularly in Fast Track trials, case management conferences, allocation hearings, and a broad range of application hearings.

Her paperwork practice includes drafting pleadings, schedules, and providing written advice on liability, causation, and quantum.

Emily is known for her thorough preparation, sound judgment, and pragmatic advocacy. She is committed to providing practical and effective advice and works closely with both professional and lay clients to achieve the best possible outcome in every case.

Alongside her personal injury practice, Emily undertakes work in clinical negligence and Court of Protection matters. Prior to commencing pupillage, she worked as a paralegal at a leading clinical negligence firm acting on behalf of NHS Resolution and NHS Trusts. This experience provided her with valuable insight into the investigation and defence of complex clinical negligence claims.

Emily has a longstanding interest in the intersection of law and medicine. During her studies, she undertook research into the use of expert medical evidence in litigation under the mentorship of Clive Stafford Smith and investigated a wrongful conviction case in the United States (Tasha Shelby) contributing research that formed part of an appeal before the Mississippi Supreme Court. She further explored medico-legal issues through her undergraduate studies, with her dissertation focussing on how the law should respond to non-consensual vaginal examinations during labour, and gained advocacy experience through pro bono representation, including assisting a family at an inquest following a hospital death. These experiences continue to inform her approach to personal injury, clinical negligence and Court of Protection work.
