Saisha predominantly practices in Commercial and Insolvency law and Professional Negligence matters.

Her practice includes advocacy, advisory and drafting work at all stages of proceedings from interim relief and pre-action advice through to trials and appeals. She regularly appears as sole counsel in the High Court and County Court and is also comfortable working in larger counsel teams or as junior counsel on more complex matters and has been led by senior members of both the Insolvency and Commercial teams.

Expertise

Saisha enjoys a diverse commercial practice. She is regularly instructed in Multi-Track, Intermediate Track, Fast Track and Small Claims matters in the County Court together with interim applications and appeals in the High Court. She has been led by senior members of the Commercial Team in high-value unfair prejudice petitions, business protection matters and other commercial matters.

Saisha’s recent experience includes:

  • Obtaining injunctive relief in respect of the misuse of confidential information by an ex-employee operating in the stormwater management sector.
  • Undertaking the advocacy in interim hearings in respect of high-value unfair prejudice petitions (led by James Wibberley).
  • Drafting a part 8 claim (led by James Wibberley) in respect of a breach of a share purchase agreement.
  • Advising and representing an individual in respect of bankruptcy proceedings and successfully obtaining an adjournment of the same in order for the client to pursue an appeal/ set aside of a summary judgment granted against him. Subsequently drafting an appeal to the High Court in respect of a refusal to grant relief from sanctions which is pending.
  • Successfully advising and representing (against a KC) an individual in relation to a breach of restrictive covenant case and obtaining significant costs against the claimant company
  • Representing a barrister in professional negligence proceedings brought by a former client and successfully having the claim dismissed.

Saisha has been involved in a wide variety of interim applications including: setting aside default judgment, strike-out applications, applications to amend statements of case, applications seeking permission to rely upon expert evidence, and applications regarding allocation.

Saisha has also advised on and assisted with large-scale disclosure exercises in complex, high-value cases both in the UK and in Jersey.

Saisha accepts instructions in a wide variety of personal and corporate insolvency matters. She is frequently instructed by office holders, companies and company directors, litigation funders, debtors and bankrupts and other insolvency process stakeholders and has appeared in both the County Court and High Court. Saisha is happy to accept instructions under a Conditional Fee Agreement.

Saisha has been led by Simon Passfield KC on several matters including:

  • Opposing an administration application.
  • Settling pleadings in a claim which alleged inter aliabreach of fiduciary duty and fraudulent trading.
  • Defending a knowing receipt claim (trial in October 2025) for which Saisha has undertaken the advocacy in respect of a number of interim/preliminary hearings.
  • 234/236 Insolvency Act 1986 applications.
  • Representing (at a preliminary hearing) the joint administrators of Axiom Ince Limited (the entity which operated a number of law firms, including Axiom DWFM, Ince & Co and Plexus Legal) in relation to underlying claims to recover £64m of misappropriated client monies

Recent examples of work undertaken (un-led) in this practice area include:

  • Advising on various breach of duty / s.423 IA claims as well as transactions at an undervalue and preference claims and possession and sale applications.
  • Successfully obtaining/resisting orders to restrain the presentation of a winding-up petition.
  • Successfully obtaining an adjournment of a bankruptcy petition where a party had applied (though the application had not been determined) to set aside/ appeal a summary judgment.
  • Successfully resisting s.127 IA applications in respect of void dispositions.
  • Numerous bankruptcy petitions and winding-up petitions
  • Appearing for officeholders in applications to fix the basis of their remuneration.
  • Advising on potential claims by liquidators in respect of void dispositions, including considering claims against a bank in respect of their failure to freeze the company’s accounts.

Saisha has acted for clients in a range of property matters including appearing for landlords, tenants and banks in possession claims and advising on and drafting forfeiture claims.
