Guildhall Chambers can provide both advocacy and advisory services across the full spectrum of fraud and financial crime cases, with members of our criminal and civil teams often working together to provide a complete service many other sets are unable to offer.
Members of our Criminal Team regularly prosecute and defend cases brought by the Serious Fraud Office, HM Revenue & Customs, and the CPS Central Fraud Group and have played key roles in investigations led by the Financial Conduct Authority and the Department for Business, Innovation & Skills.
These cases cover the whole spectrum of criminal fraud and financial crime including investment, trading and boiler room frauds, procurement frauds, so-called “romance frauds”, and frauds involving powers of attorney and relating to wills. Criminal practitioners also deal with important ancillary matters such as restraint orders, confiscation proceedings, and Directors’ Disqualification Proceedings arising out of criminal trials. They also provide business advice on compliance issues such as anti-money laundering procedures and bribery prevention.
Members of our Commercial Team handle contractual disputes involving allegations of fraudulent misrepresentation and fraudulent breach of warranty, as well as claims of conspiracy and other economic torts.
Our Insolvency Team is regularly involved in both prosecuting and defending directors’ disqualification proceedings, as well as civil claims against directors accused of misappropriating company funds. Members of both teams regularly appear in applications for freezing orders, search orders, non-party disclosure against banks and financial institutions and claims for other forms of injunctive relief.
Our Employment and Discrimination Team act for both corporations and individuals in professional disciplinary hearings brought against those accused of fraud or other offences involving dishonesty, while members of our Financial Services Team provide advice on regulatory compliance and are regularly instructed in claims against unregulated professionals.
Members of our Personal Injury and Clinical Negligence Team are regularly instructed in a range of cases involving fraud, from claims involving fundamental dishonesty and exaggeration to claims of malingering, LVI and/or staged accidents.
In nearly every case where dishonesty is alleged, there will be serious costs consequences if that allegation is proven. In many cases, members have dealt successfully with those issues at the conclusion of the case.
Members appear at all levels of court and have experience not just in the County Court and Crown Court, but also in the High Court, Court of Appeal and Supreme Court.
